Terms of Service

These Terms of Service govern your use of Hyre not Fyre, including our website and related apps. By creating an account or using Hyre not Fyre, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the service.

You must be at least 13 years old, and old enough to enter a binding agreement where you live, to use Hyre not Fyre. You are responsible for the accuracy of the information you provide and for keeping your account secure. You may not share your account or impersonate another person or business.

Hyre not Fyre is an online community and directory where festival and event workers, businesses and attendees can post and find jobs, events and for-hyre availability, message each other, join groups, sell items in the Shakedown Street marketplace, and exchange vouches and reviews.

We are a platform only. We are not an employer, staffing agency, recruiter or party to any job, agreement or sale between members. Members are responsible for their own hiring, work, payment, taxes and transactions, and for checking that a job, business or listing is legitimate before relying on it.

Everyone who joins agrees to the group rules, which are part of these terms:

1. No bad mouthing other vendors or employees. This is not a place to take our past grievances out on those that we have worked for or have worked for/with you. If you have a grievance with a past employer/employee bring it to them directly.
2. This is a safe space. No bullying. By joining this group you agree to promote a safe space for all marginalized identities, including women, and agree to be respectful, not harmful. (note: if two or more people come forward with you as their perpetrator you will be disqualified from this group, resulting in removal)
3. Employability matters. By joining this group, you agree to be a dependable and reliable worker and show up for any gigs you sign up for. Failure to do so will result in removal from the group.
4. No spam. Spam includes but is not limited to: repeatedly posting the same thing; sharing vague or irrelevant posts from outside the group; soliciting sales; posting with comments turned off; posting without clear, direct information or asks.
5. Engagement & contribution. By joining this group, you agree to help to provide helpful material: q&a, comment, messages, good helpful words.

We may remove content, restrict features, or suspend or remove accounts that break these rules or these terms, or that put other members or the service at risk.

You own the content you post. By posting it on Hyre not Fyre, you give us a non-exclusive, worldwide, royalty-free license to host, display, reproduce and distribute it as needed to operate and promote the service. You confirm that you have the right to post it and that it does not violate anyone’s rights or the law.

You agree not to post or do any of the following:

• Unlawful, harassing, hateful, threatening, sexually explicit or deceptive content.
• Fake job posts, scams, false vouches or reviews, or misleading profiles.
• Spam, unsolicited advertising, or scraping and automated collection of member information.
• Attempts to break, overload or gain unauthorized access to the service or other accounts.

Vouches, reviews, points and badges are opinions or activity indicators from members and are not guarantees of a person’s or business’s skills, reliability or identity. The Verified badge means a member passed an optional identity check through our provider; it is not an endorsement or a background check. You can report problems with another member from their profile. Reports are reviewed by administrators, and we decide at our discretion what action to take.

Some features, such as Premium plans and paid job posts, require payment. Prices, billing periods and any trial or promotional terms are shown at checkout. Payments are processed by Stripe, and you agree to Stripe’s terms when you pay. Subscriptions renew until cancelled. Promotions such as founding-member or referral rewards may be changed or ended, and may be withdrawn if they are misused.

You can delete your account at any time from your Profile page. We may suspend or end your access if you break these terms or misuse the service. Sections that by their nature should continue (such as content licenses, disclaimers and limits of liability) will survive.

Hyre not Fyre is provided “as is” and “as available.” We do not guarantee that the service will be uninterrupted or error-free, or that any job, event, listing or member is accurate, safe or suitable for you. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

To the fullest extent permitted by law, Hyre not Fyre and its owners will not be liable for indirect, incidental, special or consequential damages, or for lost income, data or opportunities, arising from your use of the service or your dealings with other members. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim or $100.

We may update these terms from time to time. When we do, we will change the “Last updated” date above. If you keep using Hyre not Fyre after a change, you accept the updated terms.
